General provisions
- These terms set out the rights, duties and liability of the seller and the buyer when goods and gift vouchers are bought in the divemen.lt online shop.
- We sell and deliver goods in Lithuania only.
- By placing an order you confirm that you have read and accept these terms. Each order is governed by the version of the terms in force when it was placed.
- Adults and legal entities may buy. Minors aged 14 to 18 may buy only with the consent of a parent or guardian, except where the law allows otherwise.
- A consumer is a natural person buying for purposes outside their trade, business or profession. The consumer rights described in these terms (the right of withdrawal and the legal guarantee) apply to consumers. Purchases by legal entities are governed by the general sale rules of the Lithuanian Civil Code.
- These terms do not limit the rights that Lithuanian law gives to consumers.
Goods and prices
- The features, contents and price of each item are given in its description. Colours in photos may differ slightly depending on your screen, and photos sometimes show accessories that are not included: the description says what is in the set.
- Prices are in euros and are final. UAB Logvira is not a VAT payer, so no VAT is added.
- The delivery price depends on the parcel size and the delivery method. It is shown in the cart and at checkout before you place the order.
- If a price is wrong because of an obvious technical error, we will tell you and offer to sell at the correct price or to cancel the order. If you cancel, we will refund everything you paid without delay.
Ordering and the contract
- Put the items in the cart, enter your details, choose delivery and payment, read these terms and press the button to place the order. By placing the order you take on the obligation to pay for it.
- You can buy as a guest or create an account. Do not share your login details with anyone.
- When we receive your order, we send an order confirmation by e-mail. The contract is concluded when this confirmation is sent. The order details are in the confirmation and, if you have an account, in your account.
- You are responsible for the accuracy of your order details. Give a precise delivery address or parcel locker and a working phone number: carriers use it to send you messages about the parcel.
- If an item you ordered is out of stock and we cannot get it, we will tell you and offer another item or a longer delivery time. If you do not agree, we cancel the order and refund your payment without delay and within 14 days at the latest.
- For each paid order we issue an invoice and send it by e-mail as a PDF. If you need an invoice for a company, tick this at checkout and enter the company details.
Payment
- You can pay through Paysera (online bank links and payment cards) or by bank transfer in advance.
- We prepare and send the order once payment has been received.
- Payment on collection is not possible: orders collected at the shop are paid online too.
- More on the Payment methods page.
Delivery
- We deliver in Lithuania only: to LP Express and Omniva parcel lockers or by courier to your address. You can also collect your order free of charge at our shop in Vilnius.
- Oversize items cannot be sent to parcel lockers.
- We deliver within 30 days of the contract at the latest, unless agreed otherwise.
- The risk of accidental loss of or damage to the goods passes to you when you, or a person you named (other than the carrier), receive them.
- Gift vouchers are sent by e-mail, so there is no delivery charge for them.
- More on the Delivery page.
Right of withdrawal
You can also withdraw on the website: Withdraw from contract here. You will receive a confirmation by e-mail.
- A consumer may withdraw from the contract within 14 days without giving any reason (Lithuanian Civil Code, Article 6.228¹⁰).
- The period runs from the day you, or a person you named (other than the carrier), receive the goods. If items ordered together arrive separately, it runs from the day the last item is received. For a gift voucher it runs from the day the contract is concluded.
- To withdraw, tell us before the period ends with a clear statement, for example by e-mail to info@divemen.lt. You may use the model withdrawal form, but you do not have to.
- Send the goods back without delay and within 14 days of your notice at the latest. You pay the direct cost of returning the goods.
- We refund all payments received from you, including the delivery cost, without delay and within 14 days of receiving your notice, using the same means of payment. We do not refund the extra cost if you chose a delivery method more expensive than the cheapest standard delivery we offered.
- We may withhold the refund until we have received the goods back or you have supplied proof of having sent them, whichever is earlier.
- You are liable only for any loss in value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
The right of withdrawal does not apply to:
- sealed goods that were unsealed after delivery and cannot be returned for health protection or hygiene reasons (such goods are marked in the product description);
- goods made to your specifications or clearly personalised.
How to return goods is explained on the Returns and exchanges page.
Gift vouchers
- The gift voucher (a PDF with a unique code) is sent by e-mail once payment is received.
- A voucher is valid for 12 months from issue; the expiry date is printed on it. After that date the voucher can no longer be used and the money paid for it is not refunded.
- A voucher can be for a service (for example, an intro dive) or for an amount that can be used to pay for courses, trips or equipment. To use a voucher, contact us and give its code. A voucher may be given to another person.
- A buyer who is a consumer may withdraw from the voucher contract within 14 days of its conclusion if the voucher has not been used. We then refund the full amount paid and cancel the voucher.
- A voucher cannot be exchanged for money, except as set out in point 4 and where we cannot provide the service on the voucher for reasons within our control.
- If the order is cancelled or refunded, its vouchers are cancelled.
Legal guarantee
- We are liable for any lack of conformity of the goods that existed at delivery and becomes apparent within 2 years of delivery (Lithuanian Civil Code, Article 6.364).
- A defect that becomes apparent within 1 year of delivery is presumed to have existed at delivery, unless we prove otherwise.
- Tell us about a defect within 2 months of discovering it: write to info@divemen.lt, give the order number, describe the defect and, if you can, add photos.
- You may choose to have the item repaired or replaced free of charge, unless the chosen remedy is impossible or would cost us disproportionately. We repair or replace within a reasonable time and without significant inconvenience to you, and we pay all related costs, including shipping.
- If the item was repaired, our liability period is extended once by 1 year.
- You may ask for a proportionate price reduction or terminate the contract if we have not repaired or replaced the item or have refused to do so, if a defect appears despite our attempt to fix it, if the defect is serious, or if it is clear that we will not fix it within a reasonable time or without significant inconvenience to you. The contract cannot be terminated for a minor defect.
- If the contract is terminated, you return the item at our expense and we refund the price within 14 days of receiving the item or proof that it was sent.
- You are also entitled to compensation for damage caused by the defect.
- Normal wear and tear and damage caused after delivery by improper use, storage or care (for example, not following the manufacturer’s instructions) are not defects.
Manufacturer’s warranty
For some goods the manufacturer gives its own warranty (a commercial guarantee). Its length and conditions are given in the product description or the warranty document. A manufacturer’s warranty does not limit or replace your rights under the law.
Liability
- The seller and the buyer are liable to each other under Lithuanian law.
- The seller is not liable for failure or delay caused by force majeure (Lithuanian Civil Code, Article 6.212).
- Use diving equipment according to the manufacturer’s instructions and your training. The seller is not liable for damage caused by improper use of goods that conform to the contract.
- These terms do not limit any liability that cannot be limited by law.
Personal data
We process buyers’ personal data as described in the Privacy policy.
